Taiwan: clearer directives to assess the likelihood of confusion between marks
New guidelines referring to European, Japanese and American examination practice 8 April 2022Taiwanese trademark practice has been implemented with precise directives to be followed when examining trademark applications, referring to European, Japanese and American examination guidelines.
Particularly, the new guidelines issued by the TIPO (Taiwan Intellectual Property Office) concern: trademark distinctiveness, similarity between marks under comparison, accurate criteria to assess the similarity between goods and services, and clarifications on good faith and bad faith applications.
