Brexit: the European Union accepts postponement to 31 January 2020

A flexible extension providing for an exit possibly even before the deadline set 7 November 2019

We inform you that the European Union – as a result of a decision by the European Council – has adopted a decision that further extends the deadline for Brexit postponing it to the 31 January 2020. It also grants a "flexible" extension that provides for an exit from the European Union by the United Kingdom – possibly even before the deadline set – but with intermediate windows scheduled for late November or December 2019.

In light of this, the European Union Trademarks and Community Designs already registered and therefore granted by the European Union Intellectual Property Office (EUIPO) will continue to be valid and will be automatically converted by the UK Intellectual Property Office (UKIPO).

We remind you, however, that applications for registration filed at the EUIPO and not yet granted at the final date of Brexit will reach registration for the remaining 27 member States only. To obtain protection in the UK a new national filing will be necessary – unless different provisions are provided in the future.

Since there are no clearer elements at the moment, the information provided in our previous communication remains valid (except for the time limits).
