The novelty requirement with respect to Industrial invention patents is met when at least one of the claimed characteristics is not present in the prior art taken as comparison. The requirement of inventive step is met when the closest prior art shows differences with respect to an the invention, and an expert of the field, with his normal knowledge, would not have been able to solve the problem in the way as described in the patents.
